Welcome to Scouse Soul. The terms “we”, “us”, and “our” refer to Scouse Soul. We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify. 

These Terms of Service (“Terms”) outline your rights and responsibilities when using our Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

 

SECTION 1 – ACCESS AND ACCOUNT

You must be the age of majority in your region to use the Services. You agree that all information you provide (billing, shipping, payment, etc.) is accurate and complete.  

You are responsible for maintaining the security of your account credentials.

 

SECTION 2 – OUR PRODUCTS

All Scouse Soul products are made on demand. This means items are created specifically for your order and may vary slightly from digital mockups.

Colours and appearance may differ due to screen settings and the nature of embroidery production.  

We do not guarantee that products will appear exactly as displayed.

We may change or discontinue products at any time.

 

SECTION 3 – ORDERS

Placing an order is an offer to purchase. We reserve the right to accept or decline any order.  

Orders are not accepted until payment is processed and we send confirmation. 

Because items are made to order, we may not be able to cancel an order once production has begun.

All purchases are subject to our Refund Policy.

You confirm that purchases are for personal use and not for resale.

 

SECTION 4 – PRICES AND BILLING

Prices may change without notice.  

The price at checkout is the final price for your order (excluding taxes, duties, or import fees where applicable).

You agree to provide accurate payment information and authorise us to charge your chosen payment method.

 

SECTION 5 – SHIPPING AND DELIVERY

All items are produced on demand before shipping. Delivery times include both production and transit and are estimates only.

We are not responsible for delays caused by carriers, customs, or events outside our control.

Under the Consumer Rights Act 2015, risk of loss will transfer to you once the order has been delivered to the address you provided, or to an identified safe place as instructed by you.

 

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services is owned by Scouse Soulº or its licensors and protected by applicable intellectual property laws.  

You may use the Services for personal, non‑commercial purposes only.

 

SECTION 7 – OPTIONAL TOOLS

We may provide access to third‑party tools “as is” without warranties. Your use of such tools is at your own risk.

 

SECTION 8 – THIRD‑PARTY LINKS

We are not responsible for third‑party websites or content accessed through our Services.  

Any issues with third‑party products or services must be directed to the third party.

 

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Scouse Soul is powered by Shopify, which enables us to provide the Services. However, any sales and purchases you make are made directly with Scouse Soul. Shopify is not responsible for any aspect of your transactions with us.

 

SECTION 10 – PRIVACY POLICY

Personal information is handled according to our Privacy Policy and Shopify’s Privacy Policy.

 

SECTION 11 – FEEDBACK

Any feedback you submit may be used by us for any purpose without obligation or compensation.

We may correct errors or update information at any time, including after an order is submitted.

To the fullest extent permitted by law, Scouse Soul is not liable for indirect, incidental, or consequential damages arising from your use of the Services or products.

 

SECTION 18 – INDEMNIFICATION

You agree to indemnify Scouse Soul and Shopify against claims arising from your breach of these Terms or misuse of the Services.

 

SECTION 19 – SEVERABILITY

If any part of these Terms is found unenforceable, the remainder will still apply.

 

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any part of these Terms does not waive our rights.  

These Terms constitute the entire agreement between you and Scouse Soul.

You may not assign your rights under these Terms without our consent.  

We may assign our rights without notice.

 

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of England and Wales.

Headings are for convenience only and do not affect interpretation.

 

SECTION 24 – CHANGES TO TERMS OF SERVICE

We may update these Terms at any time.  

Your continued use of the Services constitutes acceptance of any changes.
